years after his death, the case of oscar grant was back in court this morning. ktvu's brian flores joins us live from outside of the courthouse in san francisco to explain what was at stake. good afternoon, brian. >> reporter: hey, good afternoon, tori. well, what was at stake today was a civil case. but there was no decision made today here inside san francisco federal court. on the case of johannes mehserle and other officers involved in the shooting of oscar grant during a new year's party a few years ago. now, attorneys for anthony p. eroni and johannes mehserle argued they should be offered immunity because they argued the shooting was an accident. they also say it was tragic but there was reasonable actions by the officers to act the way they did. meanwhile, the attorneys for the victims and four others claim it was not an accident, that they were defenseless and should not be granted qualified immunity of the law. here's what both sides had to say. >> what it means is the simple fact that our rights have been violated. those young men are tie to us as a family -- are tied to us as

the rain at noon. >>> complete bay area news coverage, starts right now, this is ktvu channel 2 news at noon. >> we received a 911 call. there was screaming on the line. >> it started as a domestic violence call and ended with officers firing their weapons and the suspect dead. >>> good afternoon, i am claudine wong in for tory campbell. >>> topping our news at this hour we are learning more about that fatal officer-involved shooting in walnut creek, officers responded to the apartments on creekside drive and we are there live with new information on this investigation. >> reporter: the incident actually happened further back in the apartment complex but you can see they still have a large area roped off with crime tape while though continue to process the scene. walnut creek police say this started with a panicked 911 call at 3:15 this morning. they say they could hear screaming in the background, officers responded to a unit at the diablo point apartments where they were met by an armed man. they are giving few details about what happened next only that they felt threatened and fi

for this growhouse. janine de la vega, ktvu channel 2 news. >>> and to the latest on san francisco muni. it's back up and running after a transformer problem shut down everything for hours. ktvu aalex savidge live at the -- ktvu's alex savidge is live at the van ness station. what do you know? >> reporter: well, right here on market street, i did an interview with the mta spokesperson, he came out here and updated the situation. he says computers who use subway systems can expect a smooth right. all of the issues has been resolved. he tells me all of their trains are running on their regular schedules. let me show you the scene inside the van ness station. all of the trains again moving this morning. there was a shutdown, though, last night. it was about 6:00 when the entire subway system stopped because of a blown transformer at the van ness station. crews had to work throughout the night to fix the problem. and then finally at 1:30 this morning, they had everybody up and running again. with all of the subways out of service. you can imagine it was a major hassle for tens of thousands of commuters.
, ktvu channel 2 news. >> thank you, alex. >>> a man walking to a liquor store was among four people shot near oakland's lake merritt. investigators recovered dozens of shell casings at two separate crime scenes. at 10:30, officers were called to east 18th street. three people in their 20s have been shot there. two men and a woman. meanwhile, a stray bullet had wounded an apparent innocent bystander, heading to a liquor store a few blocks away. all of the victims are recovering in the hospital this morning. coming up at 7:30 a live report on what kind of weapons police think were used in this attack. >>> 7:03. grab an umbrella. we have rain. more of it moving into the bay area, coming down pretty good causing problems all over the bay area. ktvu's brian flores is live near larkspur right there. i can see you're wet. coming down pretty good. >> reporter: yeah, probably about a couple of minutes ago, dave, the rain started pouring pretty good here. yeah, but steve's been talking about it all morning. we're not expecting huge rain amounts from this storm but the ground is saturated from the
that was on fire. flames shot in the air on athens around 1:00 this morning. ktvu's alex savidge joins us live from the scene with video you will only see on channel 2. alex? >> reporter: well, good morning. the fire inside of that home is what triggered a second fire that came from the curbside gas valve right outside the home. that's why you see pg&e crews still doing last-minute repair work to patch up the road where they had to dig things up to access that line. that second fire coming from the gas line certainly made things difficult for firefighters this morning, as the fire ripped through both floors of the home, and flames from the natural gas line shot 15 feet in the air. the homeowners had to wait for the pg&e to turn off the gas line. this started around 1:00 on the 100 block of athens street. there were four people inside the home at the time of the fire. two of them were sent to the hospital with possible smoke inhalation. a neighbor i talked with this morning told me he feels lucky this fire didn't spread to his house next door. >> grateful, you know, it was pretty smoky downstairs wh
savidge ktvu channel 2 news. >>> it is 5:03. firefighters continue to look for answers in an apartment fire that killed a couple and their young granddaughter. the fire started saturday night just after 11:00 at a two story apartment building on bridge port court. 56-year-old bomaro his wife and their four-year-old granddaughter kira died in the fire. more than 50 other people were displaced and now being helped by the red cross. janine de la vega will have a live report coming up at 5:30. >>> time is 5:03. just about 16 hours from right now the u.s. economy will go over the fiscal cliff unless congress and the white house can work out a last minute deal. if there is no new budget deal by midnight tonight east coast time income tax rates will go up for all americans. coming up at 5:15 the two men leading the last minute negotiations. >>> the chp is trying to figure out what led up to a crash that killed a motorcycle rider in concord last night. it happened just before 6:30 on kicker pass road. the chp says no other cars were involved and it's unclear why the driver lost control. >>> th

're live in green brain -- greenbrae this morning, alex savidge, ktvu channel 2 news. >> thank you, alex. >>> rising creek waters flooded roadways an temporarily closed highway 101. it happened on the peninsula in a creek that overflowed its banks. janine de la vega is live at the creek to show us some of the damage. >> reporter: well, we're right here on the border of palo alto and east palo alto. this is highway 101 and the creek flows right underneath it and the water was so high last night that it was flashing up over and onto the freeway. this is video of that same area of what it looked like last night. water was flooding on 101, north of the embarcadero. the highway patrol was helping motorists with traffic breaks. the creek crested at university avenue and woodland. the water spilled over and into the entrance of the four seasons hotel. fire officials say even though there was not massive damage, they remain worried about the creek. >> we need to work on these holes in this levy. can't leave it like this especially since we're early in the winter and this is the second significan
problems this morning even though it's clear outside. we begin our storm coverage with ktvu's alex savidge. >> reporter: good morning. a lot of repair work to do out here. la fayette creek runs underneath this street. it flooded. that's us what caused the roadway to -- that's what caused the roadway to collapse. crews will be using this heavy equipment to execute the sinkhole created yesterday, dig debris out from the creek that overflowed yesterday. it was late in the afternoon on sunday, when the soil eroded and the pavement out here just gave way. utility lines that were impacted, a gas line had to be capped, and suerers created a -- sewers created a bypass. now, the cause of this collapse was a pipe that diverts creek water. neighbors told us they could hear it go. >> it sounded like a big thud. a big really, heavy -- it shook the ground. it was a big boom. >> reporter: so now the city is working on a long-term fix out here for this area, perhaps they will put in some sop find kind of -- some kind of a rack so they can catch a lot of the debris that tends to run down the creek when the
